After the Arizona Snowbowl and the U S Forrest Service won the court battles which should have cleared the way for the immediate construction of snowmaking equipment at the Snowbowl, they have been hit with a frivolous time wasting law suit that threatens to delay the construction of improvements at the Snowbowl for another 3 years. This suit alleges that there is some question about some potential health risk posed by the use of reclaimed waste water, this issue was already addressed in earlier court proceedings and revisiting this issue is a waste of time and tax payer dollars. In order to move forward on the improvements at the Snowbowl the Flagstaff city council is considering amending their agreement to supply the treated waste water, by including the option to supply “recovered reclaimed water”. This change should help avoid wasting the time in court to resolve this most recent lawsuit. If the city council approves this change the Snowbowl is prepared to start construction in time to start making snow as early as November 2011.
The construction of the improvements at the Snowbowl will have significant positive economic impact on the entire state by generating new construction jobs and keeping more Arizona skiers and snowboarders in Arizona instead of traveling to California and Colorado. The sooner these improvements can be made the sooner this state will start to feel the benefits of this economic stimulus.

THE FUTURE OF ARIZONA SNOWBOWL WILL BE DETERMINED ON AUGUST 30. NOW IS THE TIME TO
SUPPORT YOUR LOCAL SKI AREA. EMAILS TO CITY COUNCIL MEMBERS & LETTERS TO THE EDITOR ARE
NEEDED TO SHOW THAT SUPPORT EXISTS. ATTENDANCE AT THE COUNCIL MEETING IS CRITICAL.
Objective: Obtain favorable vote by majority of council members to amend the water contract with
Snowbowl allowing either reclaimed water or recovered reclaimed water.
Background: The U.S. Department of Agriculture, after working for over one year to find an alternative
to address tribal cultural concerns, has asked the City of Flagstaff to sell recovered reclaimed water to
Snowbowl. Recovered reclaimed water is treated effluent that percolates through the ground, where it
co‐mingles with the aquifer, then is pumped and delivered as potable water. Flagstaff has been storing
and recovering this water for almost thirty years. The existing Snowbowl contract to use reclaimed
water to make snow is offensive to tribes. There is a new frivolous lawsuit claiming that snow made
from reclaimed water is hazardous if ingested. The plaintiffs and attorney in this lawsuit have pledged
they will use any tactic to delay or stop Snowbowl from making manmade snow. The new judicial
process, including appeals, will delay construction for an additional 3 ½ years. The opposition is clear
with their intent to stop all snowmaking in hope that Snowbowl ultimately goes out of business.
The issue is which water source will be used, not whether snowmaking will occur at the Snowbowl. The
USFS issued the permit on July 2, 2010 to Snowbowl allowing either source of water.
WHY SHOULD CITY AMEND THE CONTRACT WITH SNOWBOWL?
• Matches the language in USFS permit allowing either source of water
• Would allow Snowbowl to begin construction in 2010, finish and make snow November 2011
• Project using reclaimed water cannot be financed until new litigation is finalized
• Flagstaff community realizes benefits three to four years sooner including $50 million annual
economic impact
• Over 200 construction jobs are created
• Over 300 permanent direct and indirect jobs are created within the community
• Other project elements are completed 3 to 4 years earlier including new lifts, additional ski
terrain and facility improvements.
• Supply pipeline to ski area will include fire hydrants where none exist and a reservoir at the ski
area that can be used to suppress forest or structure fires.
• Makes new frivolous lawsuit moot
• USDA / tribal meetings reveal this is the preferred solution
• Water neutral to the City; does not threaten current or future water supply
• Cost neutral to the City; contract explicitly states that the City has no financial responsibility
• Snowbowl has certainty moving forward with an aggressive schedule to construct additional
project elements to make Snowbowl a sustainable operation
• Changing the water source allows the council to create over 200 construction jobs this year
